Attorney Fees—What to Do and What Not to Do
(A Perspective from the WBA’s Fee Dispute Committee)

9:05—9:25 a.m. (20 Minutes Ethics), presented by
Richard K. Thompson and William H. Zimmerman, Jr.
Mr. Thompson and Mr. Zimmerman will discuss the services provided by the WBA’s Fee Dispute Committee, typical fee dispute complaints, and how to best utilize the Committee for resolution.

Contingent, Flat, Minimum and Retainer Fees and Agreement Examples

Richard K. Thompson and William H. Zimmerman, jr.
Mr. Thompson and Mr. Zimmerman will discuss retainer fees, Trust and Operating Account issues, and a discussion covering when a fee is earned along with the relevant ethical rules using attorney fee agreement examples.

Ethical Rules Impacting Attorney Fee Agreements
10:10 a.m.—10:35 a.m. (25 Minutes Ethics),
presented by Richard K. Thompson and William H. Zimmerman, Jr.
Mr. Thompson and Mr. Zimmerman will discuss ethical rules surrounding fee agreements, specifically Rule 1.5.

Group Discussion—Hypothetical Ethics Issues, Fee Agreements and Disputes
10:35 a.m.—11:00 a.m. (25 Minutes Ethics),
presented by Richard K. Thompson and William H. Zimmerman, Jr.
Two groups will be led by Mr. Thompson and Mr. Zimmerman to discuss a hypothetical ethics issue from the Fee Dispute Committee’s archives in this break-out session followed by open discussion and answers to questions posed by attendees.
