Ethics of Client Intake (conflicts and competence)
1:05 p.m. - 1:30 p.m. (25 Minutes—ethics), presented by Jeffrey N. Lowe
Using an interactive process, this session will include the ethical issues that can arise at the client intake stage. Specifically, what should be done when an existing client asks an attorney to handle a matter for which the attorney lacks experience? After a client has been referred to another, more qualified attorney, fee arrangements and engagement letters present possible ethical issues.

1:30 p.m. – 1:55 p.m. (25 minutes – ethics), presented by Jeff Kuhlman

Case Evaluation
2:00 p.m. – 2:50 p.m. (50 minutes), presented by Paul S. McCausland
This section will include an overview of the types of claims that can be asserted in an employment case. There will be a more in depth analysis of the interplay between the family medical leave, the ADA and worker’s compensation.

Break: 2:50 p.m. – 3:10 p.m

Administrative Proceedings from the Point of View of Both a Complainant and a Business
3:10 p.m. – 4:00 p.m. (50 minutes), presented by Ryan K. Meyer and Kelly Rundell
This session is about the administrative processes of the KHRC and the EEOC. The speakers will discuss the process from the perspective of both the claimant’s attorney and an attorney for a small business. They will discuss filing and responding to a complaint, the investigative process and mediation.

Administrative Review
4:00 p.m. – 4:25 p.m. (25 minutes), presented by Hon. William S. Woolley
This session will be devoted to describing what happens after the administrative process is completed. This session will address judicial review of a KHRC decision.

Trial Issues
4:25 p.m. – 4:50 p.m. (25 minutes), presented by Kimberly D. Farha
This session will be devoted to discussing the choice of pursuing an employment matter in either federal or state courts, or litigation issues.
