This seminar will examine the theoretical and doctrinal principles characterizing the lawyer-client relationship and explore how those principles may apply in hypothetical real-world scenarios. The Rules of Professional Conduct expressly do not govern the determination of whether a lawyer-client relationship exists. Yet the existence of such a relationship triggers most of the ethical duties the Rules impose. This two-hour presentation will delve into the often murky question of how a lawyer-client relationship forms and how it terminates. It will consider the contractual, agency, and fiduciary nature of the relationship. It will address the allocation of authority and control within the relationship. And it will engage (or at least make a strong attempt to engage) attendees to debate and apply these concepts to hypothetical situations.
