Technology and the Threat to the Attorney Client Privilege 
9:10 – 10:00 a.m. (50 Minutes), presented by Professor Suzanne Valdez

While technology makes law practice efficient and convenient, it also can be dangerous. This one-hour presentation will explore the threat of technology on client confidentiality and the attorney-client privilege. It will focus on the rules of competence, communication, confidentiality, and inadvertent disclosures.

Secretly Recording Others: Is it Ethical?
10:10 – 11:00 a.m. (50 Minutes), presented by Professor Suzanne Valdez

This one-hour presentation will explore the ethics of recording conversations with witnesses, opposing counsel, and clients. The session will briefly cover state wiretapping laws and then delve into the ethical rules and ABA ethics opinions that pertain to the duty of loyalty we owe our clients, as well as the obligation we have not to engage in dishonestly or misrepresentation with others.
