  • Welcome and Introductions
    9:00—9:10 a.m., Ty A. Patton, Moderator

  • Creditors In Probate
    9:10—10:00 a.m. (50 Minutes), presented by Jason R. Bock
    Mr. Bock will discuss the issues involving debts of a decedent, including procedural considerations, creditor rights in probate, and fraudulent transfers at or near death.

  • Undue Influence In the 21st Century
    10:05—10:55 a.m. (50 Minutes), presented by Michael Ong
    Mr. Ong will talk about the challenges to testamentary documents, both wills and trusts. The challenges seem to be more frequent and widespread. Several factors are converging: wealth transfers from the elder generation are accelerating; non-traditional families are increasing in number; families are becoming more geographically disbursed, thus creating opportunities for isolation. In 2015, The Kansas Supreme Court issued its latest ruling on the law of undue influence. This case and the elements for challenges to testamentary documents will be discussed in detail.

  • Alternative Probate Procedures
    11:10—12:00 p.m. (50 minutes), presented by Eric N. Anderson
    This presentation will cover the alternative probate procedures including: the procedure; estate taxes; real estate in other countries; and the forms needed.
  •  Lunch: 12:00 p.m.—12:45 p.m. Lunch to be served at the WBA Conference Center
  •  Dementia and Alzheimer’s and Capacity Issues
    12:45—2:25 p.m. (100 minutes), presented by Dr. Stephen L. Benson and Pamela J. Thompson
     Dr. Benson and Ms. Thompson will discuss working with patients that have dementia, Alzheimer’s and capacity issues.
  •  Break 2:25 p.m.—2:40 p.m. (15 minutes)
  •  Ethics Questions Seen In Probate Practice
     2:40 p.m.—3:30 p.m. (50 minutes) - Ethics, presented by Mitchell L. Herren and Ryan D. Farley
     Mr. Herren and Mr. Farley will discuss common estate planning and elder law planning situations which may contain ethical traps for the unwary attorney. In analyzing these potential situations, the  presenters will look to the Kansas Rules of Professional Conduct and Model Rules for guidance.
