<title>Chief Justice Issues Five Administrative Orders Affecting Court Operations During Pandemic</title>

<description><![CDATA[<p><span style="color: black;">TOPEKA—Chief Justice Marla Luckert has issued five administrative orders to give updated direction to Kansas courts and court users as courts continue to gradually conduct more in-person proceedings and increase the number and types of service delivered to the people of Kansas.</span></p>
<p><span style="color: black;"><br />
“We want people coming into our courthouses and courtrooms to know we are taking appropriate measures to protect their health,” Luckert said. </span></p>
<p><span style="color: black;"><br />
One order provides clarity about public health directives courts must follow, and others renew the suspension of certain deadlines and time limitations while courts work toward resuming full operations.</span></p>
<p><span style="color: black;"><br />
“By temporarily suspending some deadlines and time limitations, we uphold the legal and constitutional rights afforded all of us while our courts manage case processing consistent with public health guidelines,” Luckert said. </span></p>
<p><span style="color: black;"><br />
</span><strong><span style="color: black;">New administrative orders</span></strong></p>
<p><span style="color: black;"><br />
<a href="https://kansascourts.org/l/d07Uc7e6LMb7iT4kclJogz15LvydKKnxJTVO6aLPxL0" target="_blank"><span style="color: #0000ee;">Administrative Order 2020-PR-054</span></a> applies to Kansas district and appellate courts. It requires courts to comply with orders of the chief justice and the governor; COVID-19 safety directives from the Office of Judicial Administration; and public health guidance from state and local health officials and OSHA. </span></p>
<p><span style="color: black;"><br />
The order requires courts that remain closed to the public to meet certain conditions before allowing walk-in visitors, including seeking guidance from the local public health official about how to return to in-person hearings based on local risk and the courthouse facility. The chief judge must assure compliance with health recommendations, have a plan for screening people entering a courtroom or court office, and provide court contact information should someone be denied entry due to health concerns. </span></p>
<p><span style="color: black;"><br />
The order directs that all hearings should be conducted remotely, if possible. It prohibits most in-person proceedings that require more than 10 people in a courtroom, and it requires that all persons in a courtroom be at least 6 feet apart. </span></p>
<p><span style="color: black;"><br />
The order allows jury trials to proceed if it's required to preserve a person's constitutional right to a speedy trial and the court has presented its departmental justice a plan that:</span></p>
<ul style="list-style-type: disc;">
    <li style="color: black;"><span>allows for voir dire, or jury selection, involving jury panels numbering no more than 12 at a time;</span></li>
    <li style="color: black;"><span>uses a location that provides for social distancing;</span></li>
    <li style="color: black;"><span>designates how and where sidebar conversations will occur;</span></li>
    <li style="color: black;"><span>specifies how exhibits will be handled between attorneys, court staff, and jurors;</span></li>
    <li style="color: black;"><span>provides a videostream of the proceedings for public viewing, if necessary; and</span></li>
    <li style="color: black;"><span>specifies how the jury will be managed to meet social distancing requirements, addresses jurors' ability to hear and see witnesses and exhibits, and identifies where jurors will deliberate, including how they will leave for and return from deliberation.</span></li>
</ul>
<p><span style="color: black;"><a href="https://kansascourts.org/l/d07Uc7e6LMb7iT4kclJogyxvwpzsZKxxnmJ8Xx4U4bQ" target="_blank"><span style="color: #0000ee;">Administrative Order 2020-PR-055</span></a> renews the suspension of certain deadlines and time standards, including applicable statutory speedy trial provisions, for any municipal court closed or continuing trials because of COVID-19. The suspensions remain in effect until the court reopens and can reasonably place the case on its calendar, or until further order. The suspensions do not apply when a person is held in custody.</span></p>
<p><span style="color: black;"><br />
The order also continues to authorize courts to conduct hearings by two-way telephone conference or videoconference communication to the extent it is permitted by the United States and Kansas Constitutions.</span></p>
<p><span style="color: black;"><br />
<a href="https://kansascourts.org/l/d07Uc7e6LMb7iT4kclJogwWg9tXHhQDnrxE3he1zG1E" target="_blank"><span style="color: #0000ee;">Administrative Order 2020-PR-056</span></a> authorizes courts to conduct hearings by two-way telephone conference or videoconference communication. The authorization applies to criminal, juvenile offender, civil, probate, child in need of care, and other proceedings. It includes all pretrial, trial, and post-trial proceedings, including plea, criminal sentencing, probation revocation, show cause, or any other proceeding. It encourages judges and litigants to use remote proceedings whenever possible and especially when a person involved in the case expresses health concerns.</span></p>
<p><span style="color: black;"><br />
The order requires remote proceedings to allow for confidential communication, and that the proceedings be publicly available during the proceeding or by recording afterward.</span></p>
<p><span style="color: black;"><br />
The order remains in effect until further order of the chief justice or until it expires under terms specified in House Substitute for Senate Bill 102, which is 150 days following the expiration of a declared state of disaster emergency.</span></p>
<p><span style="color: black;"><br />
<a href="https://kansascourts.org/l/d07Uc7e6LMb7iT4kclJog6H8ZCAKw2dvQJ0GH_0Z_IM" target="_blank"><span style="color: #0000ee;">Administrative Order 2020-PR-057</span></a> suspends all statutory deadlines and time limitations to bring a defendant to trial. The suspension remains in effect until further order or it expires under provisions in House Substitute for Senate Bill 102.</span></p>
<p><span style="color: black;"><br />
<a href="https://kansascourts.org/l/d07Uc7e6LMb7iT4kclJog-zWNHRbJslnbToG92GfIKE" target="_blank"><span style="color: #0000ee;">Administrative Order 2020-PR-058</span></a> suspends statutes of limitations, statutory time standards, or deadlines that apply to conducting or processing judicial proceedings. Under the order, no action may be dismissed for lack of prosecution or failure to meet a deadline, except when a judge, appellate judicial officer, or hearing officer exempts a case from the suspension. </span></p>
<p><span style="color: black;"><br />
The order does not affect deadlines or time limitations to bring a criminal defendant to trial, as those are suspended by Administrative Order 2020-PR-057. </span></p>

            <p><span style="color: black;">TOPEKA—The Kansas judicial branch plan to launch a new centralized case management system in six more judicial districts in June is delayed.</span></p>
            <p><span style="color: black;">Statewide orders limiting in-person contact during the COVID-19 pandemic prevented in-person training and data review by district court staff, both of which are needed before the transition to the new system can take place.</span><br />
            </p>
            <p><span style="color: black;">"While this is a setback, it does not jeopardize this important advancement in court operations statewide," said Supreme Court Justice Dan Biles, who chairs the steering committee overseeing the project. "As soon as our court employees are able to resume working on this project, we will complete our efforts to bring this new system to the next group of judicial districts."</span><br />
            </p>
            <p><span style="color: black;">The judicial branch planned to implement the system in June in these courts:</span><br />
            </p>
            <ul style="list-style-type: disc;">
                <li style="color: black;"><span>4th Judicial District (Anderson, Coffey, Franklin, and Osage counties);</span></li>
                <li style="color: black;"><span>6th Judicial District (Bourbon, Linn, and Miami counties);</span></li>
                <li style="color: black;"><span>11th Judicial District (Cherokee, Crawford, and Labette counties);</span></li>
                <li style="color: black;"><span>14th Judicial District (Chautauqua and Montgomery counties);</span></li>
                <li style="color: black;"><span>19th Judicial District (Cowley County); and</span></li>
                <li style="color: black;"><span>31st Judicial District (Allen, Neosho, Wilson, and Woodson counties).</span></li>
            </ul>
            <p><span style="color: black;">The system already is operating in the 8th and 21st judicial districts (Clay, Dickinson, Geary, Marion, Morris, and Riley counties). The rollout to all state courts, including all judicial districts, the Court of Appeals, and the Supreme Court, originally was to be complete by the end of calendar year 2021.</span></p>
            <p><span style="color: black;">In a series of administrative orders in response to the </span><a href="https://kansascourts.org/l/se4kXZitcvgceaNuZJLd26oJ_gl4_FffRB4BKwjTnf4">COVID-19 pandemic</a><span style="color: black;">, the Supreme Court reduced or eliminated in-person contact with court staff and judges to protect the health of the judicial branch workforce and the health of people who need its services.</span><br />
            </p>
            <p><span style="color: black;">Although the Kansas Judicial Center has been closed, Office of Judicial Administration staff continue to work remotely on several aspects of the case management project:</span><br />
            </p>
            <ul style="list-style-type: disc;">
                <li style="color: black;"><span>programming and testing the system to report data to the Kansas Bureau of Investigation and the Department of Revenue Division of Motor Vehicles;</span></li>
                <li style="color: black;"><span>updating documents used by court staff to operate the case management system; and</span></li>
                <li style="color: black;"><span>working directly with people outside the court system—such as prosecutors and sheriff departments—who need access to court information beyond what is available to the general public.</span></li>
            </ul>
            <p><span style="color: black;">The ability for courts to resume regular operations will influence the new go-live date for this group of courts.</span></p>
            <p><span style="color: black;">Installation of the centralized case management system is a key component in the Supreme Court's eCourt plan. It will allow all district and appellate case data to reside on a single web-based platform, transforming the way the state court system serves the people of Kansas.</span><br />
            </p>
            <p><span style="color: black;">The judicial branch entered into an $11.5 million contract with Tyler Technologies of Plano, Texas, to customize and use its Odyssey Case Manager™ system. It will be paid for with docket fees earmarked by the Kansas Legislature for the project.</span><br />
            </p>
            <p><span style="color: black;">The primary goals of the centralized case management system implementation are to:</span><br />
            </p>
            <ul style="list-style-type: disc;">
                <li style="color: black;"><span>Improve case processing in the district and appellate courts.</span></li>
                <li style="color: black;"><span>Enable work sharing between district courts, primarily among clerks and court services officers.</span></li>
                <li style="color: black;"><span>Enable web-based sharing of public information.</span></li>
                <li style="color: black;"><span>Increase the efficiency of information delivery to district and appellate court judges.</span></li>
                <li style="color: black;"><span>Increase operational efficiency and effectiveness through automating certain activities and streamlining other operations.</span></li>
                <li style="color: black;"><span>Improve data quality and integrity.</span></li>
                <li style="color: black;"><span>Improve performance measurement, analysis, and reporting through enhanced information collection, storage, retrieval, and analysis.</span></li>
                <li style="color: black;"><span>Enable data sharing between various governmental entities based on information security requirements, contribution to the effective administration of justice, and need.</span></li>

                                                                                                <p><span style="color: black;">"Kansas courts are committed to delivering timely justice, especially during challenging times such as we are experiencing now," said Karen Arnold-Burger, chief judge of the Court of Appeals. "We decide many cases on their written record, but some attorneys want the opportunity to argue their cases before the court, and oral argument by videoconference allows us to accommodate them."</span><br />

                                                                                                <p><span style="color: black;">The Court of Appeals has allowed attorneys to appear for oral argument by videoconference since 2016, but the sessions weren't livestreamed and the three-judge panels sat together in the court’s courtroom in the Kansas Judicial Center.</span><br />

                                                                                                <p><span style="color: black;">This time, with the Kansas Judicial Center currently closed to in-person contact to prevent the spread of COVID-19, the judges and attorneys will all appear from separate locations by videoconference.</span><br />

The court's regular May and June dockets will be summary calendars only. These cases are decided on their written record without oral argument.</span><br />

                                                                                                <p><span style="color: black;">The Kansas Supreme Court had its first remote videoconference oral argument April 11 when justices heard a case filed by</span><a href="https://kansascourts.org/l/ypy2O1b7fkte2CsjQn51KXwOThhd-j8VGsR2xQiZlZw">Governor Laura Kelly against the Legislative Coordinating Council</a><span style="color: black;"> on an expedited schedule that included a Saturday morning oral argument. The Supreme Court has livestreamed oral arguments online from its Topeka courtroom since 2012.</span><br />

                                                                                                <p><span style="color: black;">The Court of Appeals is a traveling court that meets to hear cases at locations throughout the state. While oral arguments are always open to the public, they are not livestreamed.</span><br />

                                                                                                <p><span style="color: black;">The appeal involves a dispute over revenues from natural gas wells in Comanche County between two businesses, Thoroughbred Associates and Kansas City Royalty. Thoroughbred Associates operated a group of gas wells it organized into a single unit, sharing profits with each of several lease owners. Kansas City Royalty claims its lease with Thoroughbred was included in the single unit; if so, it would be entitled to a share of profits from those gas wells.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">In an earlier appeal, the Supreme Court determined language in Kansas City Royalty's lease prevented it from being included in the unit. This appeal relates to a claim that the parties agreed—after that lease had been entered into—to include the Kansas City Royalty lease in the larger combined unit of gas wells.</span></p>

            <p style="margin: 0in 0in 0.0001pt;"><span style="color: black; margin: 0px; padding: 0px; border: 0px;">“The demand for marriage licenses continues even as we honor our state’s stay at home order,” said Chief Justice Marla Luckert. “To meet this demand, our courts developed a process that allows a couple to get a marriage license without in-person contact with court staff, which is consistent with our efforts to protect the health of court workers, judges, and the people who need our services.”</span></p>

<p><b style="font-size: 12px;">Members of Civil Bar Practicing in Sedgwick County:</b><br />

<p><span style="font-size: 12px;">Friday, Apr. 3, 2020, the Kansas Supreme Court issued Administrative Order 2020-PR-32.&nbsp; It amends Ks. Sup. Ct. A.O. 2020-PR-16 issued Mar. 18, 2020.&nbsp; The most significant modifications for civil court address new Foreclosure and Eviction cases and are covered on page 2.</span><br />
</p>
<p><span style="font-size: 12px;">The new A.O. 2020-PR-32 gives further directions on what actions district courts must, can and cannot do.&nbsp; Almost all civil matters are “non-essential” functions.&nbsp; Paragraph 6 of the Order states, </span><span style="font-size: 12px; color: #212121;">“Nonessential functions may be performed in a manner consistent with this <b>order as local resources and circumstances allow.</b>”&nbsp;</span><br />
</p>
<p><b style="font-size: 12px;"><u><span style="color: #212121;">JUDICIAL DISCRETION</span></u></b><span style="font-size: 12px; color: #212121;"> </span><span style="font-size: 12px; color: #212121;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; As implied in A.O. 2020-PR-32 Section 2, prospective scheduling of hearings or trials is subject to the decision of the assigned judge.&nbsp; The decision of the assigned judge will also be subject to “local resources and circumstances”, including the need for a record and the availability of court personnel.</span><br />
</p>
<p><b style="font-size: 12px;"><u><span style="color: #212121;">CIVIL JURY TRIALS</span></u></b><span style="font-size: 12px; color: #212121;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Section 3 of A.O. 2020-PR-32 states, “All jury trials, both civil and criminal, scheduled to begin in any Kansas state court on or after March 18, 2020, are continued until further order of the Chief Justice.”&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <br />
</span></p>
<p><span style="font-size: 12px; color: #212121;">Rescheduling jury trials which were set to start between March 18, and the resumption of normal court operations will not have any certainty until after the Supreme Court reopens the courts to jury trials.</span><br />
</p>
<p><b style="font-size: 12px;"><u><span style="color: #212121;">CIVIL BENCH TRIALS </span></u></b><span style="font-size: 12px; color: #212121;">&nbsp;&nbsp; The new A.O. does not specifically prohibit bench trials.&nbsp; But they must be conducted by two-way telephonic or electronic audio-visual communication and only “as local resources and circumstances allow”.&nbsp; Sg. Co Courts are arranging for judges to be able to host recorded audio-visual “meetings” using WebEx for a 90-day trial period.</span><br />
</p>
<p><b style="font-size: 12px;"><u><span style="color: #212121;">CIVIL MOTION HEARINGS</span></u></b><span style="font-size: 12px; color: #212121;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The new A.O. does not prohibit non-evidentiary civil motion hearings.&nbsp; But they must also be conducted by two-way telephonic or electronic audio-visual communication and only “as local resources and circumstances allow”.&nbsp;</span><br />
</p>
<p><b style="font-size: 12px;"><u>HEARINGS BY REMOTE COMMUNICATION</u></b><span style="font-size: 12px;">&nbsp;&nbsp; The requirement for “two-way telephonic or electronic audio-visual communication” can be interpreted to mean <span style="color: #212121;">all participants must appear by remote, including that the party and their attorney should be remote from each other.&nbsp;&nbsp;</span></span><br />
</p>
<p><b style="font-size: 12px;"><u>NEW FORECLOSURE and CH. 61 EVICTION/COLLECTION PETITIONS</u></b><span style="font-size: 12px;">&nbsp; &nbsp; &nbsp;The clerk’s office will begin accepting new foreclosure and Chapter 61 eviction/collection petitions. <span style="color: #212121;"></span></span><br />
</p>
<p><span style="color: #212121; font-size: 12px;">&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; At this point, we can only guess at the dates that the Court will return to business as usual.&nbsp; In an effort, to avoid an overload of new case filings and overburdened appearance dockets when the Court opens, we have come up with the following schedule for setting appearance dates for Chapter 61 issuance of Summons</span><br />
</p>
<p><span style="font-size: 12px;">Until the Kansas Courts return to normal operations or until further Order of the Kansas Supreme Court or further Order of this Court:</span><br />

<p style="margin-left: 0.25in;"><span style="font-size: 12px;">The Following Schedule for Summons Appearance Dates will be applied for new Chapter 61 case filings, including eviction cases and collection cases.</span></p>

<p style="margin-left: 1in;"><span style="font-size: 12px;">The Court will be directing the Civil Clerk’s office to reject any Summons that does not comply with the above schedule.</span></p>
<p style="margin-left: 0in;"><span style="font-size: 12px;">&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;</span></p>
<p style="margin-left: 0in;"><span style="font-size: 12px;">If summons is issued as above and the Courts have not reopened by the date of any dates listed for Summons Appearance Date, we intend to send a press release to tell the Summons recipients for a specific date not to appear.&nbsp; Plaintiff’s attorneys will then need to issue an Alias Summons for a new appearance date for any cases previously filed with an appearance date set on a day the courts are not open.</span></p>
<p style="margin-left: 0in;"><span style="font-size: 12px;">Attorneys may prefer to delay filing of a Summons until after the Supreme Court extinguishes the recent A.O.s. &nbsp;Return to normal court operations may provide certainty that the courts will be open on the scheduled appearance date.</span><br />
</p>
<p style="margin-left: 0in;"><span style="font-size: 12px;">On foreclosure cases, counsel should consider the effects of the Governor’s Exec. Ord. 20-10 (Mar. 23, 2020) on claim statements in petitions and findings in a foreclosure judgment.&nbsp; Our Court will not approve an Order for a Sheriff Sale until normal court operations resume.<br />
<br />
</span><b style="font-size: 12px;"><u><span style="color: #212121;">LITIGATION MATTERS SUCH AS DISCOVERY OR MEDIATION</span></u></b><span style="font-size: 12px; color: #212121;">&nbsp; &nbsp; &nbsp;A.O. 2020-PR-32 “does not limit the conduct of litigation – including such matters as discovery or mediation – that does not involve a judge or judicial employee.”&nbsp;</span></p>
<p><span style="color: #212121; font-size: 12px;">Section 17 further states, “all statutes of limitations and statutory time standards or deadlines applying to the conduct or processing of judicial proceedings are suspended until further order.&nbsp; During the effective dates of this A.O., no action shall be dismissed for lack of prosecution.&nbsp; </span><b style="color: #212121; font-size: 12px;">Parties are encouraged to meet all deadlines that do not require in-person meetings.”</b><br />
</p>
<p><span style="color: #212121; font-size: 12px;">We have learned that some attorneys believe that deadlines in Scheduling Orders/Case Management Orders are suspended.&nbsp; That is NOT correct.&nbsp;</span></p>
<p><span style="color: #212121; font-size: 12px;">Deadlines and other dates set in a Scheduling Order/Case Management Order are established by counsel with the approval of the Court.&nbsp; They are NOT statutory deadlines.&nbsp;</span></p>
<p><span style="color: #212121; font-size: 12px;">&nbsp;</span><span style="font-size: 12px; color: #212121;">This is consistent with prior interpretation by the Sg. Co. Civil Department.&nbsp; </span><span style="font-size: 12px;">Civil deadlines included in Case Management or Scheduling Orders are still in place.&nbsp;</span></p>
<span style="font-size: 12px;">All of that being said, during this time of restricted access to courts, I do believe attorneys should </span><b style="font-size: 12px;">extend greater courtesy and deference</b><span style="font-size: 12px;"> to meeting all of the scheduling deadlines attorneys and courts commonly face.&nbsp;</span>

                                                            <p><span style="color: black;">“The need to reduce in-person contact as much as possible is paramount to our state’s COVID-19 response,” said Chief Justice Marla Luckert. “These orders clarify points in the judicial branch’s actions to reduce or eliminate in-person contact with court staff and judges to protect the health of our workforce and the health of people who need our services.”</span><br />

                                                            <p><span style="color: black;">Administrative Order 2020-PR-032 modifies Administrative Order 2020-PR-016 by:</span><br />
                                                            </p>
                                                            <ul style="list-style-type: disc;">
                                                                <li style="color: black;"><span>renaming emergency operations as essential functions;</span></li>
                                                                <li style="color: black;"><span>clarifying that litigation conduct is not limited when it does not involve a judge or court employee;</span></li>
                                                                <li style="color: black;"><span>encouraging parties to meet deadlines that do not require in-person proceedings;</span></li>
                                                                <li style="color: black;"><span>confirming state courts must have staffing necessary to carry out essential functions and nonessential functions may be performed as local resources and circumstances allow;</span></li>

                                                            <p><b><span style="color: black;">2020 House Substitute for Senate Bill 102</span></b></p>
                                                            <p><span style="color: black;">Today's administrative order clarifies that provisions in </span><a href="https://kansascourts.org/l/YnQ0ogkf3f-q78RhO1gwNuuKP-NOzb3n4Nxw5ToouBw">2020 House Substitute for Senate Bill 102</a><span style="color: black;"> became effective March 19, 2020, when it was published in the </span><a href="https://kansascourts.org/l/YnQ0ogkf3f-q78RhO1gwNss2XDjCx7jqPpgljSeSnNM">Kansas Register</a><span style="color: black;">. It permits the chief justice to issue an order suspending all statutory deadlines and time limitations to bring a defendant to trial until further order of the chief justice.</span><br />

                                                            <p><b><span style="color: black;">Essential court functions</span></b><br />
                                                            </p>
                                                            <p><span style="color: black;">Essential functions are outlined in the Administrative Order 2020-PR-32, and generally include:</span><br />

<p><span>Governor Laura Kelly directed that all executive branch offices, including OAH, will be closed from March 23 to April 5, 2020, to reduce the spread of COVID-19 (coronavirus).&nbsp; All hearings and prehearing conferences scheduled during this two week period are cancelled and will be rescheduled.&nbsp; OAH tentatively is scheduled to reopen on April 6, 2020.</span></p>

                                                                                                <p><span style="color: black;">TOPEKA —The longest-tenured judge to serve on the Kansas Court of Appeals will retire April 3.</span></p>
                                                                                                <p><span style="color: black;">Judge G. Joseph Pierron Jr., 72, joined the court in December 1990. Since then, he has written 392 published opinions and heard thousands of appeals.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">"A lot of cases are routine. Criminal cases might not be exciting, but they're important to the people involved," Pierron said. "You try to do your best on every case, and some are terrifically complex," he added.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">In 1977, the Court of Appeals had seven judges. That number increased to 10 by the time Pierron was appointed. Today, there are 14 Court of Appeals judges.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">Pierron said the Court of Appeals is able to process as many cases as it does because of help from nonjudicial staff—research attorneys and administrative assistants.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">"We couldn't get the job done without them," he said.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">The Court of Appeals hears all appeals from district courts in both civil and criminal cases, except those that may be appealed directly to the Kansas Supreme Court. Most of the time, panels of three judges hear the appeals, and they travel across the state to do so.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">Early on, Pierron said he encouraged his colleagues to talk to groups or students about the court system when they traveled to hold court.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">"We were doing mainly lectures," he said. "I remember we were at Lawrence High School early one day, and the kids were falling asleep. I thought, 'We've got to get them involved,' and I had them act as the judges and lawyers in a case. That woke them up."</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">Then he thought a visual aid might help as well.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">"I went to my youngest son, who had a large, stuffed dog, and I said, 'I think I need Spike.'"</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">"Spike the Wonder Dog" has joined Pierron in most of the 400-some presentations he has made on the U.S. Constitution and the judiciary since 1996. Spike helps illustrate a case that involved a drug-sniffing dog and how the case worked its way through the appellate system.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">Pierron shares two particular points with new judges joining the court: "We're bound to do what the law requires even if we don't like to do it. And don't get behind; keep up."</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">His advice to any judge "is that you not only do justice but give the appearance of it too. You need to look at the people in your court, show that you are interested, and ask questions that show you know what the case is about."</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">He said he felt ready to do the job when he joined the Court of Appeals in 1990.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">"I'd been a prosecutor 10 years and a trial judge for nine years, and I knew some of the judges on the appellate courts. I don't think there was any advice I needed that I didn't pick up immediately," Pierron said.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">But he recalls the first time the Court of Appeals overturned one of his trial court cases.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">"I was so angry. I went to my mentor, a fellow district judge, and he listened and then said, 'Do the best you can, and let the appellate court do its job.' You learn not to take it personally," he said.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">Pierron was born in Kansas City, Kansas, and grew up in Olathe. He graduated from Olathe Senior High School in 1964 and Rockhurst College in Kansas City, Mo., in 1968. He earned a law degree from the University of Kansas School of Law in 1971.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">He was a Johnson County district judge from 1982 to 1990 and a Johnson County prosecutor from 1971 to 1982.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">Pierron and his wife, Diana Carlin Pierron, a retired university professor and administrator, live in Lawrence. He has three children—Sam, Abby, and Dan—with his first wife, Amy Dennis Pierron, who died in 2000.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">He and Diana enjoy traveling, and he likes to read to student and adult groups. He said he will continue to speak about the Constitution if there is interest.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">"Will Spike retire and where will he go?" he wondered. "Maybe he could go on display here at the Judicial Center, or maybe the Kansas Bar Association would want him. Or maybe I'll keep him."</span><br />
                                                                                                </p>
                                                                                                <p style="text-align: center;"><b><span style="color: black;">Appointment process</span></b></p>
                                                                                                <p><span style="color: black;">By law, the governor appoints judges to the Kansas Court of Appeals, subject to a majority confirmation by the Kansas Senate. The governor has 60 days from the date the position becomes vacant to make the appointment, although the appointment process can begin immediately.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">Once the appointment is made, the incumbent must stand for a retention vote in the first general election after serving one year in office. Once retained, the judge serves a four-year term.</span><br />
                                                                                                </p>
                                                                                                <p><span style="color: black;">A Court of Appeals judge must be at least 30 years old and have been a Kansas lawyer, judge, or full-time teacher at an accredited law school for at least 10 years.</span><br />

                                                                                                <p><span style="color: black;">TOPEKA—Topeka attorney Danielle Hall will become director of the Kansas Lawyers Assistance Program effective December 30.</span></p>
                                                                                                <p><span style="color: black;">The Kansas Lawyers Assistance Program helps lawyers seek treatment for physical or mental illness, substance abuse, or emotional distress. It was created in 2001 and operates under the direction of the Kansas Supreme Court.</span></p>
                                                                                                <p><span style="color: black;">Justice Eric Rosen, the Kansas Supreme Court's liaison to the Kansas Lawyers Assistance Program, said he looks forward to working with Hall when she assumes her duties next week.</span></p>
                                                                                                <p><span style="color: black;">"Danielle is enthusiastic about the program and the lawyers it serves," Rosen said. "Her ability to connect with people and her past experience make her a good fit to lead this program."</span></p>
                                                                                                <p><span style="color: black;">Hall, who currently serves as deputy disciplinary administrator and diversion coordinator in the Office of the Disciplinary Administrator, succeeds Lou Clothier, who resigned in October.</span></p>
                                                                                                <p><span style="color: black;">"Throughout my career, the positions I've held have focused on providing service to the bar," Hall said. "I recognized this opportunity would allow me to continue to serve lawyers and their families across the state."</span></p>
                                                                                                <p><span style="color: black;">During her time working in the Office of the Disciplinary Administrator, Hall served as diversion coordinator, which involved helping lawyers implement best practices and improve their law practice management skills to better serve their clients and prevent recurring misconduct.</span></p>
                                                                                                <p><span style="color: black;">“The very nature of the work lawyers do makes them vulnerable to stress, burnout, anxiety, and depression. We also know lawyers are at a heightened risk for substance abuse," Hall said. "I understand the issues lawyers face. I am glad to be a resource to the profession through the Kansas Lawyers Assistance Program, and I look forward to growing the services we provide.”</span></p>
                                                                                                <p><span style="color: black;">Before working for the Office of the Disciplinary Administrator, Hall worked for the Kansas Bar Association as law practices services director and practice management advisor in the association's Law Practice Management Assistance Program. She also served in several roles at Washburn University School of Law, including trial advocacy coach, undergraduate mock trial program director and coach, and adjunct professor.</span></p>
                                                                                                <p><span style="color: black;">Hall has a bachelor of arts degree in political science from Washburn University, and a law degree from Washburn University School of Law. She serves as chair for the Topeka Bar Association technology committee, co-chair of the Kansas Women Attorneys Association minority women in the profession committee, and a member of the Kansas Bar Association law practice management committee. She also serves on the Kansas Task Force on Lawyer Well-Being.</span></p>

                                                                                                </span><strong><span style="color: black;">About the Kansas Lawyers Assistance Program</span></strong></p>
                                                                                                <p><span style="color: black;">The legal profession is considered one of the more stressful occupations, and statistics show attorneys are two to three times more likely to exhibit anxiety, suffer from depression, or become addicted to alcohol or drugs than the general population.</span></p>
                                                                                                <p><span style="color: black;">The Kansas Lawyers Assistance Program provides many services designed to fit the needs of lawyers and bar associations, including:</span></p>
                                                                                                <ul style="list-style-type: disc;">
                                                                                                    <li style="color: black;"><span>referrals for assessments, evaluations, therapy, or treatment;</span></li>
                                                                                                    <li style="color: black;"><span>short-term counseling sessions with a licensed counselor;</span></li>
                                                                                                    <li style="color: black;"><span>peer mentoring and support, modified interventions, and resiliency groups;</span></li>
                                                                                                    <li style="color: black;"><span>help with diversion and probation plans required by the disciplinary administrator or with monitoring contracts required by the Supreme Court's attorney admissions office;</span></li>
                                                                                                    <li style="color: black;"><span>guidance in closing a law office; and</span></li>
                                                                                                    <li style="color: black;"><span>legal education programs for local and specialty bar associations or law firms.</span></li>
                                                                                                </ul>
                                                                                                <p><span style="color: black;">The program's services are confidential and free. Funding comes from annual registration fees attorneys pay to practice law in Kansas.</span></p>
                                                                                                <p><span style="color: black;">The Supreme Court appoints 11 lawyers to serve on the Kansas Lawyers Assistance Board. The board recommends candidates for appointment to the board and makes reports to the Supreme Court.</span></p>
                                                                                                <p><span style="color: black;">The heart of the program is a statewide network of more than 130 peer volunteers who help lawyers in need; many are in recovery themselves.</span></p>
